Tier1 category is designed to attract Individuals who are able to invest in the UK or are highly skilled.

The tier1 category does not require a job offer but an individual has to satisfy the requirements for attributes, English language (investor’s are exempt) and Maintenance.

Entrepreneur Visa

 

Entrepreneur visa is designed to attract individuals who can invest £200,000 in the UK by setting up or taking over, and being actively involved in the running of, one or more businesses in the United Kingdom and are as result of this investment able to create prescribed number of jobs for UK.  Please contact us for full details of the requirements of this visa category.

 

Investor Visa

 

The investor category is designed to allow high net worth individuals make a substantial financial investment of £1,000,000 in the UK. Post Study Work Visa

 

This category would be stopped with effect from April 2010.

The Tier 1 (Post-study work) category allows the recent international graduates who have completed a degree level qualification to study and work in the UK for 2 years. This category does not require a sponsor but an applicant needs to ensure he is able to satisfy the relevant points in this category. Highly Skilled Workers (or HSMP as it was known as previously)

 

On 22nd Dec 2010 UKBA, closed the Tier1 (gen) category for intitial applicants applying from abroad. This category would however continue to be open until March 2011 for those applicants who are currently in the UK and wish to make an initial application . Please visit UKBA website for full details on the precise date until which this scheme would be open to applicants applying within the UK.

Tier1 refusals/ Fresh Applications( In-country cases)

 

We have extensive experience in making fresh applications where an applicant has made an application and has been refused. Please see our ‘Tier1 Fresh application success stories’ below in relation to some of our recent cases where we have successfully assisted clients in this situation.

 

Timing is of the essence in cases where you have received the refusal but do not wish to spend more money or time in pursuing an appeal but would rather prefer a prompt solution to remedy your visa refusal by making a fresh application instead. Please note that if you are considering putting a fresh application then it is advisable to seek legal advice before you do so, as it came sometimes result in adverse consequences such as overstay, break in continuity of stay etc.

 

‘Recent Tier1 Fresh application success stories’

 

Reason for refusal- points not awarded for Master’s degree certificate

 

Our client Ms ‘ABC’ had taken advice from legal consultants while making an application for Tier1 extension. Ms ABC had claimed points for a Master’s degree as she had assumed that she was given points for this degree at the time of her initial HSMP application in 2007. However Ms ABC was shocked to receive a refusal in which UKBA only awarded points for her Bachelor’s degree instead of her Master’s degree as her Master’s degree was awarded from a University which was an institution not capable of awarding degrees even though her college was on the UKBA calculator.  Ms ABL had appealed however the appeal was not successful as the Tribunal reached the decision that this degree which was obtained from this particular University was not an institution capable of awarding degrees.

 

We assisted Ms ABC in making a fresh application using the same day service and Ms ABC relied on her Bachelor’s degree along with higher earnings and this application was successful.

 

Reason for refusal -Invalid Application

 

Our client applied through legal representatives who failed to advice her that the photographs should not be over 1 month old. The client in this case had used the photographs which she had submitted with her previous visa over 2 years ago.

As the photographs were over 1 month old her application was rejected as invalid and she was given no right of appeal.  After she received the refusal she contacted us and we helped her to make a fresh application.

 

Reason for refusal

 

Our client had applied for a Post Study work visa but had not submitted the correct documentation as he had done this application himself without taking any legal advice. The client had appealed this refusal but was advised by his lawyer that the appeal would not be successful. This client then contacted our offices and we looked at the evidence and gave him full advice on how to get the correct evidence. We then made a fresh application on his behalf which was allowed.

 

Tier4 refusal- client decided to apply for fresh Tier1 (Post study Work Visa)

 

Our client Ms XY had applied for an extension for a Tier 4 visa but this was refused and she had also lost her immigration appeal against this refusal. Ms XY had in the meantime completed a Bachelor’s course in the UK and contacted us to see if she could apply for an in-country Tier1 (Post Study Visa) even though she had no visa left. We assisted MS XY to apply for a fresh Tier1 (Post Study Visa) application under the same day visa service and this application was allowed by UKBA.
